Description
In the second fully updated edition of the work, the crucial issues of the most important European procedural regulation for international jurisdiction and the enforcement of decisions in civil and commercial matters are thoroughly examined. The monograph initially analyzes the material and territorial scope of Regulation 1215/2012, including certain aspects of parallel proceedings for food cases, bankruptcy proceedings, and arbitration. Subsequently, in relation to international jurisdiction, the special jurisdiction rules for contract and tort disputes are presented, as well as those for the location of the branch, the special protective provisions of the regulation in insurance cases, consumer contracts, and individual employment contracts, the exclusive jurisdiction of the location of the property, the autonomous European concepts of lis pendens and related actions, and finally the crucial issue of extending international jurisdiction. The issue of extension is analyzed both in terms of the prerequisites of the extension clause and in terms of the subjective and objective limits of it. As for significant insurance measures, these are examined in separate sections within the work. Finally, there is an autonomous, extensive analysis of the new procedure for the enforcement of judicial decisions that has arisen as a result of the abolition of exequatur. The new procedure for refusing enforcement in the executing Member State is accompanied by the phenomenon of expanded procedural possibilities for securing the creditor.
