Description

Lawyers, judges, law professors, we have a "traditional" understanding of social justice; we have studied it and until today we approach it interpretively within the framework of the nation-state, that is, as a principle of the constitution. Not that this approach is outdated; on the contrary, notes Dimitris Orfanidis. However, when we live in the era of globalization, it is useful to investigate whether it exists as a principle beyond the state and how. It is a principle that is limited to national constitutions and has no binding force beyond them unless it is abolished due to superior supranational laws or is also enshrined at the international level, in which case it applies nationally as well. The author contributes to this problematic with the objectivity imposed by science but also by his judicial capacity. Of course, the study expresses his views; however, reading it, I realize that the author does not seek to convey to the reader a predetermined position, which must be proven, but that he starts a reflection and proceeds with an open mind. He reaches some conclusions, but these are not the product of a preconceived decision.
